2. Quotations & Proposals
Quotations are valid for the period stated in the proposal. A project is considered confirmed only once the agreed advance payment is received and/or written confirmation is provided by you. Any work outside the agreed scope (additional pages, revisions, features, or campaigns) may be quoted separately.
3. Client Responsibilities
- Provide accurate information, content, images, logos, and access credentials required to complete the work.
- Review deliverables and provide consolidated feedback or approval within agreed timelines.
- Ensure you hold the rights to any material you supply to us for use in your project or campaigns.
- Make payments as per the agreed schedule.
4. Payment Terms
- Most projects require an advance payment to begin, with the balance payable as per the milestones stated in your proposal or invoice.
- Final files, source code, account handovers, or website go-live may be withheld until all dues are cleared.
- All fees are exclusive of applicable taxes (such as GST) unless stated otherwise.
- Third-party costs such as domain, hosting, premium plugins/themes, stock assets, and advertising spend are billed separately or paid directly by you.
5. Intellectual Property
Upon receipt of full and final payment, ownership of the final deliverables created specifically for you transfers to you, except for third-party components and any of our pre-existing tools, frameworks, or templates, which remain our property or that of their respective owners. Until full payment is made, all work product remains our intellectual property. We may showcase completed work in our portfolio and marketing material unless you request otherwise in writing.
6. Third-Party Services
Our services may rely on third-party platforms (hosting providers, domain registrars, advertising networks, payment gateways, plugins, and analytics tools). We are not responsible for outages, policy changes, price changes, or actions taken by these third parties, but we will make reasonable efforts to assist you.
7. Performance Disclaimer
Digital marketing and advertising results depend on many factors outside our control, including market conditions, competition, and platform algorithms. While we apply industry best practices, we do not guarantee specific rankings, traffic, leads, sales, or return on investment.
8. Confidentiality
Both parties agree to keep confidential any non-public business information shared during an engagement and to use it only for the purpose of delivering the agreed services.
9. Limitation of Liability
To the maximum extent permitted by law, our total liability for any claim arising from our services shall not exceed the total fees paid by you for the specific service giving rise to the claim. We are not liable for any indirect, incidental, or consequential losses, including loss of profit or data.
10. Termination
Either party may terminate an engagement with written notice. In the event of termination, you remain responsible for payment of all work completed up to the date of termination. Advance amounts already utilised toward completed work are non-refundable.
11. Governing Law
These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts of Bijnor, Uttar Pradesh, India.
12. Changes to These Terms
We may update these Terms from time to time. The latest version will always be available on this page with a revised “Last updated” date.
Refund & Cancellation Policy
Our services are custom, time-based, and effort-intensive. This policy explains how cancellations and refunds are handled.
1. Nature of Our Services
Because each project involves planning, resources, and skilled work that begins as soon as an order is confirmed, advance payments are generally non-refundable once work has started.
2. Cancellation by the Client
- Before work begins: If you cancel before any work has started, you may be eligible for a refund of the advance, less any administrative or third-party charges already incurred.
- After work begins: If you cancel once work is in progress, charges for the work completed up to that point will be deducted, and only the unused balance (if any) will be considered for a refund.
3. Non-Refundable Items
The following are non-refundable in all cases:
- Completed milestones, delivered work, and services already rendered.
- Domain registration, hosting, premium plugins/themes, stock assets, and other third-party purchases.
- Advertising spend (ad budgets) paid to platforms such as Google, Meta, etc.
- Training, course, or academy fees once access or materials have been provided.
- Custom design and development work that has been approved or delivered.
4. Cancellation by Us
In rare cases where we are unable to deliver a service, we will inform you promptly and refund any amount paid for work that was not delivered.
5. How to Request a Refund or Cancellation
To request a cancellation or refund, email us at hello@thewebcosmos.com with your name, project/invoice details, and the reason for your request. Eligible refunds are processed to the original payment method within 7–10 business days of approval.
Shipping & Delivery Policy
Web Cosmos provides digital services only. We do not sell or ship any physical products, so no physical shipping is involved.
1. How Deliverables Are Delivered
All deliverables are provided digitally through one or more of the following methods, as appropriate to the project:
- Email or shared cloud links (Google Drive, WeTransfer, etc.).
- Direct deployment or publishing to your website, hosting account, or social/ad platforms.
- Account or dashboard access (for example, login details for a completed website or campaign).
- Login credentials or course access (for training/academy services).
2. Delivery Timelines
Delivery timelines depend on the scope and complexity of each project and are stated in your proposal or invoice. Timelines begin once we receive the confirmed advance payment and all required materials from you.
3. Delays
Delivery may be delayed if required content, approvals, access, or feedback are not provided on time, or due to third-party platform issues outside our control. We will keep you informed of any expected delays.
4. Delivery Confirmation & Issues
Deliverables are considered delivered once sent to your registered email address or made accessible to you. If you do not receive a deliverable or face any access issue, please contact us at hello@thewebcosmos.com and we will resolve it promptly.
